Debate, and discuss, just dont Bore me.

We have been treated to many stories of activist judges who legislate from the bench.  And nothing irks many sane people more than a judge or justices imposing their warped will on people who have voted their own way, just because the Judge does not like the way the majority voted.

But now comes a case of just plain incompetence!  In a Child Molestation case, a judge slapped a convicted child rapist, who admitted to molesting a child numerous times to a mere 60 days in jail!  60 Days! Judge Edward Cashman says he no longer believes in Punishment!  If that is the case, he should retire!  But to let a child molester in essence walk is a travesty of Justice!  Much less an abrogation of his responsibility as a civil servant!

The case occurred in (somehow this does not surprise me) in Vermont, but even the citizens of Vermont are not happy with his incompetence and shenanigans.  Nor would I be. While judges are usually shielded from lawsuits based on mis-adjudicated cases, in this case, I think the principal of Malfeasance of office should come into play, and this Judge should serve part of the rapists term!

If ever there was a clear cut case of a miscarriage of justice, this bozo clearly has made that case.  And I hope that whatever it takes to remove him from the bench, the people of Vermont do post haste.

The thing that gets me is that this judge in question has become disillusioned with incarceration as a whole and wants to actively become a force for change from the bench.

From the article you linked:
Prosecutors argued that confessed child-rapist Mark Hulett, 34, of Williston deserved at least eight years behind bars for repeatedly raping a little girl countless times, starting when she was seven.

But Judge Edward Cashman disagreed explaining that he no longer believes that punishment works.

"The one message I want to get through is that anger doesn't solve anything. It just corrodes your soul," said Judge Edward Cashman speaking to a packed Burlington courtroom. Most of the on-lookers were related to a young girl who was repeatedly raped by Mark Hulett who was in court to be sentenced.

Anger does corrode one's soul. Especially the anger that comes from lack of closure. But he wouldn't understand that, since he apparently ignores facts about recidivism and lack of rehabilitation for sex criminals. This formerly effective judge should step down before he makes more egregious rulings that repeatedly slap the faces of the victims and their families.

You wouldn't want to know what kind of sentence I'd impose on that judge if I had the chance.......

Yes, I hope they get him off the bench, there needs to be a public cry of outrage....

maybe he doesn't have any daughters, granddaughters.....maybe he's.....naw.

I have a bit of rage in myself......

Anger does corrode one's soul. Especially the anger that comes from lack of closure.

And as many here have pointed out, rehabilitation does not work on Child molesters. So his arguement of getting him into therapy was very lame if he was even cognizant of what a child molester is.

there needs to be a public cry of outrage....

Fortunately, the people of Vermont are finally getting a sense of outrage according to the story.
