OK, who hear believes that Newsmax.com is right wing media? Show of hands please? One, two, three, four, five - wait, kingbee, you can only vote once. OK pretty much everyone here. OK, Now I am going to ask how many think that CNN is left wing? One, two, three, four, Zoomba, let Moderateman raise his hand!
OK, a couple of left of center, and pretty much all of the right of center people. Pretty much what I expected. OK, now for a couple of headlines:
Judge OKs subpoenas of Limbaugh doctors - CNN, December 12, 2005
Fla. Judge Upholds Rush Limbaugh's Medical Privacy Rights - Newsmax, December 12, 2005
Same story, different headlines. But the ruling was actually 2 parts: Part one, concerned subpoenaing the doctors. The state won that part and CNN dove right into that immediately. However part 2 was in upholding the doctor-patient confidentiality and the state lost that one. But how do you know that?
You had to read down to paragraph 7 to find that little nugget of information:
Roy Black, Rush Limbaugh's attorney, said in a statement that the decision upheld "our argument that the state cannot breach doctor-patient confidentiality just because it has obtained some medical records," Black said.
So if I read the judge correctly, and the actual ruling, the State can talk to the doctors anything they want, just nothing to do with the doctor patient confidentiality. That sounds like a victory for Roy Black and Rush Limbaugh, not a victory for the state. What are they going to talk to the doctors about? Their golf game? Or their latest investments? Might make for a great discussion, but hardly something the DAs should be doing on Taxpayer time.
So now, does anyone want to change their vote?
