A woman, Viola Trevino, managed to con the State of New Mexico's Department of Social Services for 5 years.  And almost ruined a man's life over it.  What was his crime?  He divorced her.

In 1999, after being granted a divorce, Trevino alleged he had fathered another child and that she was due child support.  No child support was part of the agreement as their 2 children were both adults at the time.  Fathered a child, even though she had had a tubiligation and he a vasectomy years earlier!

Needless to say, the father of the supposed child, Steve Barreras was understandably highly dubious of this miraculous conception, and demanded proof.  DId the State or the courts ask to see the child?  Noe.  They did order a paternity test that apparently the daughter (real one) of the union took for the mystery baby.  So the court order child support.  Never having seen the child.  When the State Department of Social Services was asked to investigate, they tried to contact Trevino, then when she did not respond, closed the case.

This went on for 5 years!  Until finally, a Judge ordered her to produce the child.  Instead of trying to skip town, she picked up a kid off the street and tried to pass her off as her daughter.  The plan only fell apart when the child's grandmother followed her into the courtroom.

So here we have a women guilty of perjury, fraud upon the state, fraud upon Mr. Barreras, and I am sure some other throw away crimes as well.  Yet did she go to prison?  Yes, but for none of that.  She went to prison for Income Tax Fraud!

The point of all this?  Quite simple.  It proves that the courts and the State Dept of Social Services care nothing for the rights of fathers (or alleged fathers).  In this country, they are second class citizens, by default!  Without benefit of trial or charges.  In a country that prides itself on "Innocent until Proven Guilty", there is one class of citizens that do not enjoy that right.  Divorced Fathers.

The anti-men stuff really bugs me.
It also proves that the courts do not hold women to the same standard as men.
The courts wouldn't have hesitated to charge a man with perjury, fraud, income tax fraud, and probably "felony-bumbhood" too!

I wont go so far as to say "any women", but deffinitely Mothers.  There is a bias in the courts that basically say a father is scum, until such time as he can prove himself a saint.

In a way, it dovetails with Gideon's crusade.  Both are the cause of a supposed well meaning bureaucracy that has decided they are above the Constitution.

Yes it is a terrible case of bad social work and court systems. The children shoul dalways be seen in cases like that. I hope she actually learns her lesson! Though it is doubtful, she will probably come out and find another way to work the systems for free cash etc. Some people are just out and out shyters! (spell)

And unfortunately, it is also all too common over here. This is not unique, except in the level of the incompetance. But it happens often in the states.

This is definately horrible. There are so many reasons why some of our laws and policies are so outdated and not working now. Many times it's the people who are in charge of the system that makes it a failure and why there will always be things like this happening.

And that is what this is really all about.  The law (except for some incompetant judges) did not fail, the pencil pushers failed, and then the judges failed.  The law was not at fault here.
